Welcome to PonyProof!
PonyProof, Inc. (“PonyProof”) helps contractors and subcontractors send, receive, and track important insurance documents electronically. We also help insurance agents and insurers comply with their clients’ insurance compliance needs. We are committed to respecting the privacy rights of all of our users. This Privacy Policy describes when and how we collect information, what information is collected, and how we store, use and protect that information. The Privacy Policy covers only information connected with use of the PonyProof service and the www.ponyproof.com website and does not apply to any information collected or used by a linked or partner site. If you have questions or concerns regarding this Privacy Policy, you should contact privacy@PonyProof.com.
This Privacy Policy is not the only document that governs your use of the PonyProof service. Your agreement with PonyProof is governed also by the Terms of Service, which you must accept during the sign-up process before you can use our PonyProof service.
When we collect information:
PonyProof will not collect any personal information about you unless you have consented to our Terms of Service and registered on our website.
We will record the information you give us when you register, and retain it until you ask us to close your account by sending an email to support@PonyProof.com.
When you send, request, or create a proof of insurance document, you are making a decision to share your identity and your information and insurance documents with one or more of your business partners. Once you have shared any information or documents with a business partner, it is important for you to understand that your business partner may then share that information and those documents with any third party. For instance, an insurance agent may use the PonyProof service to notify your insurer that the agent has created an insurance document for you. PonyProof cannot stop users from sending any information or documents to any third parties, so you should only exchange information and documents with parties that you know and trust.
If you have shared any information or documents with one or more business partners, it will remain in our system until all of your sharing partners have closed their accounts.
When you register with PonyProof, we ask you for certain information, including your phone number, so that your business partners can contact you. During our beta period, we may also use your phone number to give you help using our system or to solicit feedback from you to make our system work better.
What information we collect:
When you register, PonyProof will ask for and record your first name, last name, your company or organization name, your password, and your phone number. You may update this profile information at any time by logging into your PonyProof account and selecting "user setup." ”.
When you access our website, our servers automatically recognize your domain name, type of computer, web browser, and IP address (the number assigned to computers on the Internet). No personal information about you is revealed in this process. PonyProof may also gather anonymous traffic data that does not personally identify you, but that may be helpful for improving our system.
How we use and protect your information:
We do not, at this time, collect or share with any of our content partners any personally identifiable information of our users. We do, however, share with our content partners aggregated, anonymous information about our user base, including demographic information, so that they can understand the makeup of the audience for advertising purposes and gauge the effectiveness of the PonyProof service, as well as to help us make better decisions about how to serve our users. In addition, we may use anonymous IP addresses to help diagnose problems with our servers or to administer our website.
If you submit personal information to us (for example, by e-mailing us for support), we may use your personal information to fulfill your requests and provide the PonyProof service. We may use your personal information to verify your identity or to follow up with transactions you have initiated using the PonyProof service. In that process we may share your personally identifiable information with our employees, contractors, or agents
Unless you explicitly request additional information from PonyProof, the only e-mails you will receive from us will be confirmation e-mails and critical service updates.
We require all employees, contractors or agents to comply with our Privacy Policy, and we use commercially reasonable efforts to limit their access to and use of your personal information.
In certain limited circumstances, we may be called upon to release your personally identifiable information in response to a court order, subpoena, search warrant, law, or regulation, or to comply with state or federal law. We must cooperate with such requests.
PonyProof also reserves the right to support the prosecuting of users who, in our judgment, violate our Terms of Service, or who injure or interfere with PonyProof’s or others’ rights or property, even when this may require disclosure of your personal information.
Although the PonyProof service uses standard encryption technology, there is no guarantee that any communications between your computer and the Internet are completely secure. You should use the same level of caution that you normally use to protect your confidential personal information when using the Internet.
Use of cookies:
A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on our site to deliver content specific to your interests, to save your password so you don’t have to re-enter it each time you visit our website, and for other purposes. However, we do not link the information we store in cookies to any personally identifiable information you submit on our site. We do not employ any data capture mechanisms on our website other than those described in this Privacy Policy.
We use both session ID cookies and persistent cookies. We use session ID cookies to help you navigate our site and to authorize your access to various parts of the site. We use persistent cookies to learn about usage of our site so that we can enhance it. A persistent cookie remains on your hard drive even after you close your browser. You can remove persistent cookies by following the directions provided in your Internet browser’s “help” file.
If you reject cookies, you may still be able to use our site, but your ability to use some areas of our site may be limited.
Choices you have regarding the collection, use, and distribution of your personal information:
PonyProof gives you tools to ensure the information you have provided to us remains accurate and is used appropriately. If your personally identifiable information changes, or if you no longer desire to use our service, you may change or delete your information by making the change on our “user setup” page, by e-mailing us at support@PonyProof.com,, or by contacting us by telephone using the contact information listed at the end of this Privacy Policy.If for any reason you are concerned with the way we are using your personal information, or would like to request that we delete your personal information, please contact privacy@PonyProof.com.
Even if you request that we delete your personal information, records of meetings arranged between you and other PonyProof users may remain in the PonyProof system if those other users maintain an open PonyProof account. Please also note that we may continue to use your information in aggregated form as described above.
Links and other sites:
Our website and service may contain links to other websites, including without limitation to our partners’ sites. Please be aware that our partners’ or such other websites and advertisers on our website and any websites we link to may collect personal information about you. You should consult their privacy policies for information about how they protect such personal information. This Privacy Policy does not apply to, and cannot control the activities of, those advertisers or other websites. If you choose to visit other websites or interact with advertisers, we are not responsible for the privacy practices or content of those other websites or advertisers.
Merger, sale or bankruptcy:
If PonyProof is acquired by or merged with a third party, or PonyProof sells all of its assets to a third party, we reserve the right, in any of these circumstances, to sell or otherwise transfer the information we have collected from our users, including but not limited to any personal information, as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used. Therefore, you should know that in such event, your personal information may be treated like any other PonyProof asset, and maybe be sold, transferred or shared with third parties, or used in ways not contemplated or permitted under this Privacy Policy, without notice to you or your consent.
The PonyProof service is not intended for persons under the age of 18, and PonyProof will not knowingly collect personal information from people under 18. We will promptly delete any such information as soon as we learn about it.
Confidentiality and security:
PonyProof uses physical, managerial and technical safeguards to preserve the integrity and security of your personal information. Though PonyProof uses these safeguards, no data transmissions over the Internet can be guaranteed to be 100% secure. Once we receive your transmission, we make commercially reasonable efforts to ensure security on our systems. However, this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, managerial or technical safeguards. Consequently, we cannot ensure or warrant the integrity and security of any information you transmit to or store with us and you do so at your own risk.
PonyProof will attempt to notify you in writing by email, if we are in possession of your email address, or by any other contact information you give us, of any security breach that requires your attention. PonyProof cannot guarantee that PonyProof will give, or that you will receive, any such notice.
Changes to this Privacy Policy:
We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy, simply by posting such addition, change, update or modification on our website and without any other notice to you. Any such addition, change, update or modification will be effective immediately upon posting on our website. It is your responsibility to revisit our Privacy Policy from time to time to stay aware of any changes and ensure that you continue to agree with all of the terms of this Privacy Policy.
In general, we will only use your personal information in the manner described in the Privacy Policy in effect when we received the personal information you provided. If we decide that we would like to use your personal information in a manner that is materially less protective of your privacy than the Privacy Policy in effect at the time we received your personal information, we will seek to provide you notice and obtain your consent to the new use or disclosure. Privacy Policy changes will be indicated by a change to the effective date at the end of the policy. We will post a notice and link to our main Web page.
